Terms of Use

1. General

These Terms govern the use of the GrekFit app for iPhone and Apple Watch (the “App”). The service provider is Roman Hrekul (Hrekul Roman Yuriiovych), sole proprietor (FOP), taxpayer ID (RNOKPP) 3503209173, registered address: apt. 4, 41 Shkrumeliaka St., Kolomyia, Ukraine (“we”).

By installing or using the App you agree to these Terms and the Privacy Policy. If you do not agree, do not use the App.

2. License (EULA)

The App is licensed to you under Apple’s Licensed Application End User License Agreement (the “Apple EULA”). These Terms supplement the Apple EULA. For the license to use the App, the Apple EULA prevails.

3. Account

• The App is for people aged 18 and over.
• Sign-in is via Sign in with Apple. You are responsible for the security of your Apple ID and for activity in your account.
• One account per person.

4. Basic version and Full Access

The Basic version is free: the first week of the training program and basic workout logging.

Full Access requires a subscription: all programs, club and leaderboard, nutrition, workout log and statistics, Apple Watch and other features marked in the App. Features may change; we will give advance notice of any material reduction.

5. App Store subscription

• Prices are in US dollars; the App Store shows the price in your local currency including taxes, and that price applies at purchase.
• Free trial: 14 days free for new subscribers (once per Apple ID). After the trial the price of the selected plan is charged automatically unless you cancel at least 24 hours before the trial ends.
• Payment is charged to your Apple ID at confirmation of purchase (or after the free trial).
• Auto-renewal: the subscription renews for the same period at the same price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• Manage and cancel: Settings → your name → Subscriptions, or apps.apple.com/account/subscriptions. After cancellation access continues until the end of the paid period.
• Any unused portion of a free trial is forfeited when you purchase a subscription.
• Refunds are handled by Apple under its policies: reportaproblem.apple.com. We have no access to payments.
• Apple will notify you in advance of price changes and ask for consent where required.

6. Medical disclaimer

The App is not a medical device and does not provide medical advice, diagnosis or treatment; you train at your own risk and choose your own load. Consult a doctor before starting training or changing your diet — see the Health disclaimer, which forms part of these Terms.

7. Club and user content

In the club you may show your name, photo, status and other data. You are responsible for what you post.

Zero tolerance for objectionable content and abusive users. Prohibited: insults, threats, harassment, hate speech, discrimination, sexual or violent content, spam, advertising, impersonation, infringing others’ rights.

• You can report or block a member from their card.
• We review reports within 24 hours, remove violating content and may restrict or remove the offender’s account.

8. Intellectual property

Training programs, videos, texts, design and the GrekFit name belong to us or our partners and are protected by law. You may use them only within the App for personal, non-commercial purposes. Copying, distributing or selling content without our written consent is prohibited.

9. Prohibited conduct

• interfering with the App or server, circumventing access restrictions;
• decompiling the App except where permitted by law;
• using automated means to collect data;
• inflating points or rankings with fake workouts.

10. Limitation of liability

The App is provided “as is”. We work to keep it stable but do not guarantee uninterrupted or error-free operation. To the extent permitted by law, we are not liable for injuries, health damage or indirect losses related to using the App. Nothing in these Terms limits consumer rights that cannot be limited under the law of your country of residence.

11. Termination

You may stop using the App and delete your account in the App at any time. We may restrict or terminate access if you breach these Terms. Subscriptions are cancelled through Apple.

12. Changes to the Terms

We may update these Terms. We will notify you in the App about material changes before they take effect. Continued use after that means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of Ukraine, unless mandatory rules of your country of residence provide otherwise. We aim to resolve disputes through negotiation first — email support@grekfit.com.
